This website (“Site”) is an information service which is the property of Rebecca N. Tortorici (Owner”). By using the Site, you agree to be bound by the terms and conditions stated in this Agreement which may be modified at any time by the Owner. Modifications made by Owner are effective immediately upon posting of such modifications.
- Copyright. Owner holds the copyright on the entire contents of the Site under the United States copyright laws. You may print and/or download only portions of materials from different areas of the site solely for your own personal, noncommercial use. You may make one machine readable copy and/or one print copy of any portions of material downloaded from the different areas of the site solely for your personal, noncommercial use. Any other copying, retransmission, or publication of any of the contents of this Site is strictly prohibited without the express written consent of Owner. You agree not to modify or delete any proprietary notices from materials downloaded and/or printed from the Site.
- Use of the Site. You understand and
acknowledge that Owner does not guarantee
or warrant that files available for downloading
through the Site will be free of infection
or viruses, worms, Trojan horses, or other
code that manifest contaminating or destructive
ties. You assume total responsibility
and risk for your use of the Site and
the Internet. Owner does not make any
express or implied warranties, representations,
or endorsements whatsoever with regard
to the Site or the Internet generally,
and Owner shall not be liable for any
costs or damage arising directly or indirectly
from any such use. Owner does not warrant
that the Site will be uninterrupted or
error-free or that defects in the Site
will be corrected. The Site and the software
are provide on an “as is, as available” basis.
The Site may contain links to other sites which Owner believes may interest you. However, Owner and/or Site make no express or implied representations, warranties or guaranties of any kind regarding information posted by any other linked sites ; it is your sole responsibility and obligation to investigate the veracity, accuracy, security/safety, and reliability of any content provided on any linked sites.
In no event will Owner be liable for (1) any incidental, consequential, or indirect damages arising out of the use or inability to use the Site, or any information downloaded from the Site, even if Owner has been advised of the possibility of such damage, or (ii) any claim attributable to errors, omissions, or other inaccuracies in the Site and/or materials and information downloaded through the Site.
- Indemnification. You agree to indemnify, defend, and hold harmless Owner from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this Agreement or any activity related to your use of this Site (including negligent or wrongful conduct) by you.
- Third Party Rights. The provisions of this Agreement are for the benefit of Owner and her agents, web designers, licensors and suppliers, and any third party information providers to the Site. Each of these individuals and/or entities shall have the right to assert and enforce those provisions directly against you on his/her/their/its own behalf.
- Termination. This Agreement may be terminated by Owner without notice, at any time, without reason, at the sole discretion of Owner. The provisions of Paragraphs 2, 3, 4 and 6 shall survive any termination of this Agreement.
- Miscellaneous. By using this Site, you agree and acknowledge that this Agreement is made and performed in the Commonwealth of Pennsylvania. This Agreement shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania. You agree that the only proper jurisdiction and venue for any legal action arising out of this Agreement is the York County Court of Common Pleas, York County, Pennsylvania and/or the United States District Court for the Middle District of Pennsylvania. Any cause of action or claim you may have with respect to the Site must be commenced within one (1) year after the claim or cause arises or such claim or cause of action is forever waived, relinquished and barred. Owner’s failure to insist upon strict performance or failure to claim a breach of any provision of this Agreement, shall not be construed as a waiver of any provision or right, nor construed as a bar to Owner’s later insistence on strict performance or assertion of claim for any breach. Owner may assign its rights and duties under this Agreement to any party at any time without notice to you.
